DISCLAIMER

These services described below are some of the rules that dictate the responsibilities of notaries and are not intended to serve as legal advice. For more complex scenarios or additional inquiries, it may be appropriate for the client to consult a qualified attorney.

Before Requesting Notarial Services:

Administer oaths or affirmations

One of the most important tasks of a notary is the administration of oaths and affirmations, which are the solemn truthfulness of  a signatory, witness or new official.

An oath is a promise to a deity and an affirmation is a promise of personal honor. Both are legally binding promises to tell the truth and punish the juror or claimant for perjury. If the document requires the signatory of the document to appear in person before a notary and testify to the truth of the facts/statements contained in the document.

Take acknowledgments

The purpose of  an acknowledgment is for a signer, whose identity has been verified, to inform the notary or notaries that he/she  signed the document voluntarily.

When the document requires the signatory to appear in person before the notary and confirm that he/she is signing the document voluntarily and that he/she understands the content and purpose of the document to be signed.

Verify vehicle identification numbers (VINs)

In accordance with Florida law, an individual seeking a Florida title for a previously owned motor vehicle must provide a signed statement affirming that the vehicle identification number (VIN) and odometer reading are accurate. Moreover, a qualified individual must conduct a physical examination of the vehicle to verify the VIN. Notaries public are authorized to certify this information and may utilize a form that has been created by the Department of Highway Safety and Motor Vehicles.

Before notarization, the notary will ensure that all information on the form is complete. The form mandates that the notary public verify that he or she has physically inspected the vehicle and verified that the VIN matches the number recorded on the document.

The notary public must then sign the form, print his or her name, include the date, and affix his or her notary seal.

Solemnize marriage

Florida is one of  three states where notaries can perform weddings. In addition to Maine and South Carolina, Florida allows licensed and certified  notaries to perform marriages for people with valid marriage licenses.

Before setting up an appointment, couples should acquire their marriage certificate. For further information, kindly get in touch with your nearby clerk of court.

Certify the contents of a safe-deposit box

Under Florida law, a financial institution can open a safe deposit box if the rent is late, as long as proper notice is given and certain other conditions are met. The public notary is authorized and obliged to be present when the safe is opened, to inventory the contents of the safe and to issue a corresponding certificate of opening. A notary does not need to assess the value of the contents of the safe.

Attest to photocopies of certain documents

A notary public may make certified photocopies if the following criteria are met in  Florida Statutes Section 117.05(12). The document must be an original document. A notary  cannot make a certified photocopy of a photocopy or  another certified copy.
